ETILER ENTERPRISES LLC – WEBSITE TERMS & CONDITIONS

These Website Terms & Conditions (“Website Terms”) apply to online reservations and website use. The actual vehicle rental is governed by the Rental Vehicle Agreement and Rental Summary signed at pickup/delivery (the “Rental Documents”). If there is a conflict, the signed Rental Documents control.

1. DEFINITIONS

1.1 “Company/We/Us/Our” means Etiler Enterprises LLC, Houston, Texas.
1.2 “Renter/You” means the person making the reservation and renting the vehicle.
1.3 “Vehicle” means the vehicle reserved/rented.
1.4 “Rental Documents” means the Rental Vehicle Agreement, Rental Summary, Condition Report, and any add-on disclosures provided at checkout/pickup/delivery.
1.5 “Pay Now” means the prepaid amount charged at booking as shown at checkout.
1.6 “Security Deposit Hold” means the refundable authorization hold placed at pickup/delivery.
1.7 “Fee Schedule” means fees disclosed at checkout/pickup, in the Rental Summary, and/or posted by Company.

2. RESERVATIONS & AVAILABILITY

2.1 Reservations are subject to vehicle availability and verification at pickup/delivery.
2.2 We may refuse service or cancel a reservation if eligibility, identity/payment verification, safety requirements, or fraud screening requirements are not met.

3. ELIGIBILITY REQUIREMENTS (AGE / LICENSE / INSURANCE)

3.1 Minimum age is 21 (unless we publish a different requirement for a specific vehicle/class).
3.2 A valid driver’s license is required at pickup/delivery and must remain valid throughout the rental.
3.3 Proof of auto liability insurance is required at pickup/delivery. You must present current proof of active insurance (at minimum, an insurance ID card) showing the named insured and effective and expiration dates. We may request a declarations page or other documentation if limits/coverage are not shown or are unclear. Your insurance must meet at least the minimum financial responsibility limits required by Texas law. If you cannot meet requirements at pickup/delivery, we may decline to release the vehicle and the cancellation/no-show policy will apply. We do not evaluate, verify, or guarantee that your insurance applies to this rental; confirming coverage is your responsibility.

4. PAYMENT METHODS (CREDIT CARD ONLY)

4.1 CREDIT CARD REQUIRED. We do not accept debit cards, prepaid cards, gift cards, or virtual/online-only cards.
4.2 We may require the physical card to be presented at pickup/delivery.
4.3 Accepted Credit Cards. We generally accept major credit cards such as Visa, Mastercard, American Express, and Discover, subject to availability and card verification at pickup/delivery.
4.4 Available Credit / Authorization Holds. To qualify, the credit card must have available credit sufficient to cover Pay Now (if applicable) and the Security Deposit Hold. Any authorization hold is not a charge but will reduce your available credit and those funds may not be available for your use during the hold period.

5. CARDHOLDER MUST MATCH RENTER; CORPORATE CARDS

5.1 The credit card used for Pay Now and the Security Deposit Hold must be in the Renter’s name and must match the driver’s license presented at pickup/delivery.
5.2 Corporate/company cards are accepted only if the Renter’s name is printed on the card and matches the driver’s license.
5.3 We do not accept third-party cards (spouse/friend/family) unless we approve in writing in advance.

6. FULL PREPAYMENT AT BOOKING (PAY NOW)

6.1 When you book online, you authorize us to charge the Pay Now amount shown at checkout.
6.2 Pay Now includes the base rental charges and any services selected at checkout (including delivery/collection if selected).

7. SECURITY DEPOSIT HOLD AT PICKUP/DELIVERY

7.1 At pickup/delivery handover, we will place a $200 Security Deposit Hold on your credit card (refundable), regardless of whether you pay any portion of the rental charges in cash.
7.2 The Security Deposit Hold is separate from Pay Now and may be used to cover amounts owed under the Rental Documents.
7.3 Bank release timing varies and is outside our control.
7.4 Additional Authorizations (Additional Holds). We may obtain additional authorization holds if:

  • (a) the vehicle is not returned on the scheduled date/time;
  • (b) the rental is extended or materially changed; and/or
  • (c) additional charges are incurred or reasonably anticipated (e.g., late return, extra services, tolls/tickets received during the rental, or other permitted charges).

Additional holds (if any) will be disclosed at pickup/during the rental where practical.

8. FEES, TAXES & ADMINISTRATIVE CHARGES (NO AMOUNTS LISTED)

You agree to pay all rental charges, taxes, and fees disclosed in your Rental Summary, checkout flow, our Fee Schedule, or otherwise provided to you at the time of booking or pickup.

In addition to the base rental rate, your total charges may include, where applicable:

  • (a) Taxes & Government-Related Charges, including charges related to vehicle registration, licensing, title, and similar governmental costs that may be recovered through a separately itemized fee;
  • (b) Location-Based Charges (if applicable) based on facility or property requirements;
  • (c) Tolls, violations, and related administrative/processing fees; and
  • (d) Optional products and services selected by you.

All such fees and charges, if applicable, will be disclosed to you prior to or at the time of payment/authorization and may vary based on location, vehicle, rental duration, and other factors.

9. CANCELLATION POLICY (24-HOUR RULE)

9.1 Cancel at least 24 hours before the scheduled pickup time: full refund of Pay Now to the original payment method.
9.2 Cancel less than 24 hours before pickup: Pay Now is non-refundable.
9.3 Same-day reservations are non-refundable.
9.4 Refunds (if applicable) are issued to the original payment method only.

10. NO-SHOW POLICY

10.1 A “No-Show” occurs if you do not arrive within 45 minutes of the scheduled pickup time AND you have not contacted us in advance to request a delay.
10.2 If you contact us before pickup and we confirm in writing (text/email), we may hold the vehicle for a limited time. If we do not confirm, you may be treated as a No-Show.
10.3 No-shows are non-refundable.

11. CHANGES, EXTENSIONS, AND REBOOKING

11.1 Changes to pickup/return time or date are subject to availability and may change the rate.
11.2 Extensions must be approved in writing before the scheduled return time and may require additional payment.

12. PICKUP, RETURN, LATE RETURN (WEBSITE SUMMARY)

12.1 The rental period begins at vehicle handover and ends when the vehicle is returned and accepted.
12.2 Late returns may result in additional charges as stated in the Rental Documents and/or Fee Schedule, including additional rental time/days and late fees.
12.3 If you keep the vehicle beyond the agreed return time without our written approval, the vehicle may be treated as an unauthorized possession where permitted by law.

13. DELIVERY & COLLECTION (OPTIONAL SERVICE)

13.1 Delivery/collection is optional and subject to availability and service area. We do not guarantee delivery/collection availability for every booking or location.
13.2 Delivery/collection fees (if any) are shown at checkout/pickup and/or in the Rental Summary.
13.3 Delivery handover: you must be present, present your driver’s license and credit card, sign required documents, and complete the condition inspection.
13.4 If you request “leave keys/vehicle without meeting,” you assume responsibility from the time the vehicle/keys are left at the agreed location (as described in the Rental Documents).
13.5 Waiting time / delivery no-show: if we arrive and you are not present/ready, we may charge waiting time and/or treat the booking as a no-show according to the Fee Schedule and the Reservation/Cancellation terms.
13.6 Collection: you remain responsible for the vehicle and keys until we regain possession.

14. AUTHORIZED DRIVERS, PERMITTED USE, PROHIBITED USE, GEOGRAPHIC LIMITS

14.1 Only the Renter and any additional driver(s) approved by us and listed in the Rental Summary may operate the vehicle.
14.2 Prohibited uses include (examples): driving under the influence; racing/speed testing; off-road use; towing/pushing; use for hire or commercial transport (including Uber, Lyft, taxi, delivery); criminal or reckless use.
14.3 TRAVEL RESTRICTIONS (TEXAS ONLY / NO OUT-OF-COUNTRY)
The Vehicle may not be driven outside the State of Texas. The Vehicle may not be taken outside the United States under any circumstances.
Any violation of this section is a material breach and may result in immediate termination of the rental and recovery of the Vehicle, where permitted by law.

15. CONDITION REPORTS, INSPECTIONS, AND PERSONAL PROPERTY

15.1 You must inspect the vehicle at pickup/delivery and report existing damage before departure (photos recommended).
15.2 Return inspections may occur after drop-off; undisclosed new damage may be charged as permitted by the Rental Documents.
15.3 Personal items left in the vehicle are the renter’s responsibility. We are not responsible for loss or damage to personal property to the extent permitted by law.

16. FUEL POLICY (FULL-TO-FULL)

16.1 Fuel is Full-to-Full: the vehicle is provided full and must be returned full.
16.2 If returned with less fuel, you authorize charges for missing fuel plus a refueling/service fee (disclosed at checkout/pickup or on our Fee Schedule).

17. MILEAGE POLICY (200 MILES/DAY)

17.1 Each rental day includes 200 miles per day (total included miles = 200 × charged rental days shown on the Rental Summary).
17.2 Additional miles are charged at $0.40 per mile unless disclosed otherwise at checkout/pickup.
17.3 Mileage is determined by the vehicle’s odometer (and/or telematics where applicable). Odometer tampering is a material breach.

18. CONNECTED VEHICLE / TELEMATICS DISCLOSURE (LOCATION & VEHICLE DATA)

18.1 The Vehicle may be equipped with manufacturer-installed or third-party connected vehicle technology (telematics) that can collect and transmit certain vehicle and trip information, which may include location data, odometer/mileage, diagnostic/maintenance data, speed/harsh driving indicators, and event/crash data.
18.2 We may use such information for legitimate business purposes, including vehicle recovery, safety, preventing unauthorized use, verifying mileage/usage restrictions, responding to emergencies/incidents, maintenance, and handling claims, to the extent permitted by law.
18.3 You consent to such collection and use by booking and renting the Vehicle. We do not guarantee that telematics will be available or functioning at all times.

19. SMOKING, VAPING, PETS, CLEANING FEES

19.1 Smoking and vaping are strictly prohibited in the vehicle.
19.2 If the vehicle is returned with smoke/vape odor, burn marks, ash, or other evidence of smoking/vaping, you may be charged a $250 cleaning fee.
19.3 Excessive dirt, trash, stains, strong odors, or excessive pet hair/odor may result in additional cleaning/detailing fees as disclosed in the Fee Schedule.

20. TOLLS; TICKETS; FINES; VIOLATIONS

20.1 You are responsible for all tolls and toll violations incurred during the rental.
20.2 We may offer an optional daily toll handling option (price shown at checkout/pickup). If you do not purchase it and still use toll roads/lanes, you authorize us to charge actual toll amounts plus a processing/administrative fee (disclosed at checkout/pickup or posted fee list).
20.3 You are responsible for all parking tickets, traffic/camera citations, fines, penalties, towing/impound charges, and related costs incurred during the rental.
20.4 You authorize us to charge these amounts plus a reasonable processing/administrative fee when received/confirmed. Charges may post after the rental due to agency/operator reporting delays.

21. INSURANCE & OPTIONAL PROTECTIONS (WEBSITE SUMMARY ONLY)

21.1 Insurance coverage (if any) is governed by the applicable policy and Texas law. Website summaries do not modify any policy.
21.2 Our initial program requires you to carry your own auto liability insurance that may apply to rental/non-owned vehicles, and to present proof of active insurance at pickup/delivery. We do not verify or guarantee your coverage applies. To the fullest extent permitted by Texas law, you (and your insurer, if applicable) are primarily responsible for liabilities arising from your use of the Vehicle, except to the extent Texas law requires otherwise.
21.3 Optional products such as Damage Waiver (DW) and/or Supplemental Liability Insurance (SLI) may be offered. If offered and purchased, details, exclusions, and terms are provided at checkout/pickup and in the Rental Documents. DW is not insurance.

22. ACCIDENTS, THEFT, INCIDENT REPORTING; DAMAGE; FINAL AUDIT; IDENTITY & FRAUD; CLAIMS AUTHORIZATION; GOVERNING LAW; SEVERABILITY; CONTACT

22.1 In the event of an accident, theft, vandalism, or damage, you must notify us as soon as possible and in any case within 24 hours, and obtain a police report/incident number where appropriate. You must not admit fault, promise payment, or settle any claim without our consent.
22.2 Unless limited by purchased optional protection and applicable law, you may be responsible for damage, loss, theft, towing/storage, loss of use, diminished value (where permitted), and claim/admin fees as described in the Rental Documents.
22.3 FINAL AUDIT: You authorize us to perform a final audit after the rental and to charge your card for amounts due that were not known/posted at return (including but not limited to: tolls, tickets, fuel differences, mileage overage, cleaning, damage, and administrative/processing fees). Some post-rental charges may occur days/weeks after return due to inspection results or third-party reporting delays.
22.4 Identity & Fraud Prevention: We may verify identity/eligibility using reasonable methods (license validation, contact verification, payment verification, fraud screening). We may request additional documentation when reasonably necessary. We may refuse service or cancel if we reasonably suspect fraud or requirements are not met. We do not obtain a consumer credit report for ordinary short-term rentals.
22.5 Claims Cooperation & Limited Authorization: You authorize us to communicate with your insurer for limited purposes (claim status, coverage confirmation, claim numbers, payment instructions) related to this rental. This is not a power of attorney; we cannot sign on your behalf or endorse checks payable to you.
22.6 Communications/SMS: If you provide a mobile number, you consent to rental-related calls/texts. Message/data rates may apply. Reply STOP to opt out of marketing texts.
22.7 Texas law governs. Venue for disputes is Harris County, Texas, unless otherwise required by law. If any provision is unenforceable, the remainder remains in effect.
